A decide has denied requests from attorneys for Daniel Penny that the fees in opposition to him be dismissed.

Chances are you’ll recall that Penny restrained Jordan Neely for threatening individuals on a New York Metropolis subway practice and Neely died shortly after. After all, Penny was simply making an attempt to maintain Neely from harming individuals on the practice and he didn’t act alone. Others helped to restrain Neely.

Penny was hailed as a hero by individuals who have been driving the practice and felt threatened by Neely.

The worst factor about this case, apart from the injustice, is that individuals are not going to intervene to assist others almost as a lot sooner or later. Why would they? The authorities are simply going to come back after you if something goes unsuitable.

Decide gained’t dismiss subway chokehold dying case in opposition to U.S. Marine vet Daniel Penny

A decide has denied a movement by attorneys for Daniel Penny, the U.S. Marine veteran who positioned Jordan Neely in a lethal chokehold aboard a New York Metropolis subway final 12 months, to dismiss the case.

The choice got here in courtroom on Wednesday. The decide ordered Penny again to courtroom in late March. His trial is tentatively anticipated to start out within the fall.

Penny’s attorneys Steven Raiser and Thomas Kenniff stated they disagree with the decide’s determination.

“While we disagree with the Court’s decision not to dismiss the indictment, we understand that the legal threshold to continue even an ill-conceived prosecution is very low,” Raiser and Kenniff stated in a press release. “We are confident that a jury, aware of Danny’s actions in putting aside his own safety to protect the lives of his fellow riders, will deliver a just verdict. Danny is grateful for the continued prayers and support through this difficult process.”

Penny needs to be exonerated of those costs.

A rustic with a two-tiered justice system is doomed.
