Obama Judge Rules President Trump Cannot Fire Court-Appointed Democrat US Attorney * The Gateway Pundit * by Cristina Laila

A federal judge on Thursday ruled that President Trump cannot fire court-appointed interim US Attorneys.

Over the summer, the Democrat interim US Attorney, who was promptly fired by President Trump shortly after he was appointed by a panel of district judges, filed a lawsuit to block his removal.

In July, President Trump immediately fired the Democrat US Attorney appointed by a panel of district court judges in Washington state after Democrats blocked Trump’s nominee.

Democrat jurist Roger Rogoff was fired less than one hour after he was selected to replace Trump’s nominee.

The Western District of Washington district court chose Rogoff after Democrats blocked Trump’s choice Neil Floyd.

Neil Floyd is currently the First Assistant US Attorney in Seattle.

Roger Rogoff filed a lawsuit against the Trump Administration. Rogoff’s attorneys accused the Trump Administration of using Neil Floyd’s status as a “First US Assistant Attorney” to keep him indefinitely in the position without a presidential nomination and senate confirmation.

Rogoff’s attorneys said the Trump Administration is violating the Constitution.

On Thursday US District Judge Stanley Bastian, an Obama appointee, ruled that Trump cannot fired court-appointed US attorneys.

A federal judge on Thursday ruled that President Donald Trump doesn’t have the power to fire court-appointed U.S. attorneys, rejecting a core tenet of the Trump administration’s approach to top prosecutorial jobs.

“The president cannot unilaterally fire a United States attorney appointed by the district court,” U.S. District Judge Stanley Bastian said in a ruling from the bench. Doing so, Bastian said, “would upend the framework created by the Constitution and the statutes, which together balance the president’s right to appoint and the Senate’s right to confirm.”

The ruling came in a lawsuit brought by Roger Rogoff, whom Trump purportedly fired from the job of U.S. attorney for the Seattle-area Western District of Washington immediately after the district’s federal judges appointed him to the role in July.

In his ruling, Bastian, an Obama appointee, determined that Rogoff is the U.S. attorney and has legally occupied that role since he took the oath of office on July 15. The judge also stripped power from Charles Neil Floyd, whom the Trump administration had temporarily installed in Rogoff’s place, determining that the administration had “improperly granted” authority to Floyd.

In July, Todd Blanche weighed in and said President Trump can fire a court-appointed US Attorney.

“District court judges can appoint a temporary U.S. Attorney, and POTUS can fire them. WDWA judges abandoned the time-honored process of consultation with the administration so that the selected U.S. Attorney is qualified to serve in the administration,” Blanche said.

“Roger Rogoff has been fired by the President,” he said.
